Nairobi, Kenya – Tata Chemicals has received a favorable ruling from the High Court of Kenya, which has declared it lacks jurisdiction over an ongoing dispute involving its Kenyan subsidiary, Tata Chemicals Magadi Ltd (TCML). The court’s order, dated October 23, 2026, prevents further judicial steps in the matter, providing a crucial development for the Indian chemicals major.
TCML, which operates the Magadi soda ash business, is currently examining the High Court's order and will determine its next legal and strategic steps. The ruling comes amidst a protracted regulatory conflict between Tata Chemicals and the Kenyan government regarding TCML's operations.
Background to the Dispute
The dispute escalated earlier this year when Kenyan President William Ruto publicly stated his intention to halt Tata Chemicals' operations, alleging that the company had not adequately benefited Kenya. He also indicated plans to introduce new companies to take over the Magadi operations.
In late July, the Kenyan government ordered TCML to suspend operations at its Magadi Soda factory and halted exports of soda ash, severely disrupting the subsidiary's business. In response, Tata Chemicals announced plans earlier this month to establish a high-level technical committee jointly with the Kenyan government. This committee, co-led by Kenya's Principal Secretary for Mining and TCML's CEO, was intended to review regulatory issues and propose a sustainable framework for mining, value addition, and community development, aiming to resolve the operational suspension.
Tata Chemicals had previously affirmed that TCML submitted all required information and documentation to the Kenyan government on August 11, asserting full compliance with applicable regulatory requirements. The company has maintained that the Magadi plant, acquired in 2005, remains an integral part of its global operations and has expressed commitment to resolving outstanding issues through constructive engagement and appropriate legal channels.
Next Steps for TCML
While the High Court's decision marks a significant turning point, the path forward for TCML's operations and its relationship with the Kenyan government remains to be fully defined. The subsidiary’s review of the order will guide its subsequent actions in this complex regulatory and legal environment.
