NCW Declares TCS Nashik a 'Toxic Workplace,' Citing Pervasive Harassment & POSH Non-Compliance

The National Commission for Women (NCW) has labeled Tata Consultancy Services' Nashik unit a 'disturbing, toxic workplace,' reporting pervasive sexual harassment and systemic bullying. A fact-finding report submitted to the Maharashtra government found zero compliance with the POSH Act and a lack of formal complaint mechanisms.

NCW Report Uncovers Systemic Issues at TCS Nashik

The National Commission for Women (NCW) has issued a scathing report on Tata Consultancy Services' (TCS) Nashik unit, branding it a "disturbing, toxic workplace." The comprehensive fact-finding report, submitted to the Maharashtra government, details widespread sexual harassment, systemic bullying, and a complete disregard for the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013, commonly known as the POSH Act.

The Commission initiated its inquiry after taking suo motu cognisance of numerous serious allegations made by women employees at the Nashik office. Under the direction of NCW chairperson Vijaya Rahatkar, a special committee visited the premises on April 18 and 19. During their visit, the committee engaged with victims, members of the internal committee, police officers, and other witnesses, culminating in a report exceeding 50 pages with over 25 recommendations.

Allegations of Abuse and Non-Compliance

The NCW's findings paint a grim picture, describing an environment where "pervasive sexual harassment" and "abuse of authority" were rampant. The report alleges that certain individuals, including Danish, Tausif, and Raza Memon, effectively controlled the office and specifically targeted "young and vulnerable girls" with sexual, emotional, and mental harassment, including attempts of molestation. These individuals were reportedly protected by Ashwini Chainani.

Beyond sexual harassment, the report also cited instances of religious insults, "anti-Hindu commentary," bullying, stalking, and demeaning conduct towards female employees. A significant concern highlighted was the complete absence of a formal complaint mechanism at the Nashik BPO, compounded by the fact that the Pune and Nashik offices shared a single internal committee, a clear violation of workplace law. The committee also noted that CCTV cameras in the office were non-functional, and no awareness or orientation programs regarding the POSH Act had been conducted.

Company Response and Ongoing Investigation

Initially, TCS had stated it had not received any complaints through its ethics or POSH channels and maintained full compliance with the POSH Act, asserting that CCTV cameras were functional. However, following the NCW's findings, sources within the IT company indicated that TCS intends to approach the NCW to present its side of the story.

The controversy also drew attention from political figures, with Shiv Sena (UBT) leader Priyanka Chaturvedi criticizing TCS on X (formerly Twitter). She reiterated the NCW's findings regarding the lack of a complaint mechanism, the control exerted by senior employees, and the alleged transfer or termination of employees who spoke out.

Meanwhile, the Nashik Police investigation into the matter is ongoing. So far, five individuals have been arrested, and nine cases have been registered in connection with the allegations. Accused Nida Khan was previously sent to 14 days' judicial custody by the Nashik Road Court, and a bail application has been filed.
