Delhi HC Restores CJP's X Account, Citing NEET Exam Conclusion

The Delhi High Court has ordered the restoration of the Cockroach Janata Party's X (formerly Twitter) account. The court ruled that the government's initial concern about creating panic during the NEET exam is no longer valid as the examination has concluded.

Delhi High Court Orders Unblocking of CJP's X Account

The Delhi High Court has directed the immediate restoration of the X (formerly Twitter) account belonging to the 'Cockroach Janata Party' (CJP). The court's decision, delivered by Justice Swarana Kanta Sharma, comes after the conclusion of the National Eligibility cum Entrance Test (NEET), removing the government's primary justification for the block.

Government's Concerns During NEET Exam

The Union Government, represented by Solicitor General of India Tushar Mehta, had initially sought the blocking of the CJP's account, citing fears that its posts could create widespread panic and confusion among students and parents during the critical NEET examination period. This concern was presented as the sole reason for the account's suspension.

Court Rules Justification No Longer Valid

CJP founder Abhijit Dipke filed a plea challenging the block. Justice Sharma noted that with the NEET examination now complete, the government's apprehension of disruption or panic has effectively "run its course." The court concluded that the original reason for the block no longer held merit, thus ordering the account's unblocking.

The ruling underscores the principle that restrictions on online communication must be proportionate and time-bound, especially when the underlying justification for such restrictions ceases to exist.
