Australia's New Immigration Law Raises Questions for International Students and Workers

· · 3 min read

Australia's new Migration Amendment Act 2026 empowers the Home Affairs Minister to temporarily suspend temporary visas for specific groups outside the country. This raises concerns for international students and workers planning re-entry.

Australia has enacted a significant change to its immigration framework with the introduction of the Migration Amendment (2026 Measures No. 1) Act 2026. This legislation amends the existing Migration Act 1958, granting the Minister for Home Affairs new powers to issue an "arrival control determination."

What Does the New Law Entail?

Under this new provision, the Australian government can temporarily suspend the effect of certain temporary visas held by specified groups of individuals who are currently outside Australia. These restrictions may be implemented in response to unforeseen overseas circumstances that could either impact the original justification for granting the visa or increase the risk of visa holders overstaying their permitted period in Australia.

The law stipulates that the Minister must adhere to prescribed legal conditions and consider the national interest before issuing such a determination. Additionally, written agreement from both the Prime Minister and the Minister responsible for diplomatic privileges and immunities is required.

Who Could Be Affected by Visa Suspensions?

The first application of this new power, announced on March 25, 2026, specifically targeted individuals outside Australia holding Visitor (Subclass 600) visas linked to Iranian passports. This initial restriction was set for a six-month period and did not broadly cover all international visitors, students, or temporary workers.

However, the legislation allows for future determinations to identify other categories of visa holders. This means that while Indian students, professionals, and business travelers are not automatically affected, they must remain vigilant. Any subsequent government order could apply to their specific visa type and circumstances, potentially causing re-entry difficulties if they are overseas when a determination takes effect.

Are There Any Exemptions?

The Migration Amendment Act 2026 includes several exemptions. These categories typically cover holders of specified humanitarian visas and certain family members of Australian citizens and permanent residents. Parents of children under 18 who are already in Australia are also covered by an exemption.

While the Minister has the discretion to issue a permitted travel certificate to allow an individual to travel despite an applicable determination, this is not a guaranteed solution. Travelers should not rely on this option as a primary means of bypassing restrictions, as the Minister is not obligated to consider every request.

Advice for International Travelers to Australia

In light of these new powers, international students, workers, and visitors planning travel to or from Australia are strongly advised to check the official Australian Department of Home Affairs website before booking any international trips. It is crucial to verify one's visa subclass, review any active arrival control determinations, and confirm whether an exemption applies to their situation.

Furthermore, travelers should confirm their re-entry status before departing Australia, especially if their travel plans are flexible or their visa circumstances have recently changed. Proactive checks can help avoid unexpected complications upon return.
