HP India Fined ₹142 Crore by CCI for Cartelization in PC and Printer Markets

The Competition Commission of India (CCI) has imposed a ₹142.37 crore fine on HP India and its resellers. The penalty addresses two separate cases of cartelization involving personal system products and printer consumables.

The Competition Commission of India (CCI) has imposed a significant penalty of ₹142.37 crore on HP India and several of its resellers. The fine addresses findings of anti-competitive practices, specifically cartelization, in two distinct market segments.

Two Cases of Cartelization Identified by CCI

The regulatory body's investigation uncovered two separate instances where HP India and its associated resellers engaged in practices deemed illegal under India's competition law. These actions are reported to include price-fixing, coordinated bidding, and market manipulation.

Personal System Products Market

In the first case, the CCI found evidence of cartelization in the sale and supply of personal system products, which encompass PCs, laptops, and related hardware. For its role in these activities, HP India has been directed to pay a penalty of ₹126.87 crore. Additionally, five of its resellers involved in this segment face collective fines totaling approximately ₹1.22 crore.

Printer Consumables Market

A second order from the CCI focused on the market for printer consumables, including toner and ink cartridges used with HP printers. Here, HP India received a fine of ₹11.98 crore. Sixteen other resellers were also penalized, with their combined fines amounting to ₹2.30 crore.

CCI Orders Immediate Halt to Practices

Under Section 3 of the Competition Act, 2002, the CCI has mandated that HP India and its implicated resellers immediately cease these anti-competitive practices. The Commission noted that HP India itself had initiated the proceedings by filing a lesser penalty application under Section 46 of the Act, alleging cartelization among itself and its resellers.

The official statement from the Commission highlighted that "Based on the evidence on record, the Commission found 16 tier-2 resellers of HP India to have indulged in seeking and submitting support/cover bids in contravention of Section 3(3)(d) read with Section 3(1) of the Act. The Commission also found HP India to have played a central role in the cartel arrangement among these resellers."
