West Bengal's BJP Govt. Moves to Implement National Labour Codes

West Bengal's newly elected BJP government is preparing to implement India's modernised Labour Codes. This move aims to streamline industry compliance, digitize processes, and facilitate easier factory retrenchments for businesses in the state.

The newly elected Bharatiya Janata Party (BJP) government in West Bengal is reportedly moving forward with plans to implement India's comprehensive Labour Codes. This initiative is a significant step towards modernizing and codifying the nation's labour laws, aiming for near-universal adoption across all states.

Sources indicate that the West Bengal government has initiated discussions and will soon begin drafting the necessary rules to notify the Codes. This development means that nearly all Indian states, with Kerala being the primary exception, would be on board with the new labour legislation. Even Kerala's Congress-led United Democratic Front is anticipated to face increasing pressure to adopt these reforms.

Boosting Industry and Investment

The implementation of the Labour Codes is viewed as a crucial, industry-friendly measure by the new West Bengal administration, led by Suvendu Adhikari. These reforms are designed to reduce compliance burdens, digitize various processes, and simplify retrenchments and factory closures for establishments employing fewer than 300 workers. The government is keen on fostering a more attractive environment for industry and investment within the state.

Many other states, including Karnataka and Maharashtra, have already started drafting rules and notifying specific provisions under the new Codes, some even before the Centre's full notification.

The Four Labour Codes

After years of deliberation, the Central government officially notified four key Labour Codes on November 21, 2025. These include:

  • The Code on Wages, 2019
  • The Occupational Safety, Health and Working Conditions Code, 2019
  • The Industrial Relations Code, 2020
  • The Code on Social Security, 2020

While certain provisions of these Codes became effective immediately, the Union Labour Ministry engaged in extensive discussions with stakeholders before commencing the notification of central rules in May of this year.
