According to a Bloomberg report, the US Department of Justice (DOJ) is expected to drop its criminal case, while the US Securities and Exchange Commission (SEC) is moving towards settling a parallel civil fraud complaint.
Allegations and Adani's Response
The allegations center on an alleged $265 million bribery and fraud scheme. In a November 2024 filing to stock exchanges, Adani Green Energy confirmed that the US DOJ had issued a criminal indictment and the US SEC had filed a civil complaint in the US District Court for the Eastern District of New York. These filings named Gautam Adani and Sagar Adani, with another director, Vneet Jaain, also mentioned in the criminal indictment.
The Adani Group has consistently denied the accusations, calling them “baseless” and asserting its intent to pursue “all possible legal recourse” to defend itself against the claims.
Path to Resolution
The reported move by US authorities suggests a potential end to a period of uncertainty for the conglomerate. The criminal case, if dropped, would remove a significant legal cloud. Similarly, a settlement of the civil complaint would address financial penalties sought by the SEC, which, as noted in Adani Green's November 2024 filing, had not quantified the amount of penalty at the time.
Earlier this year, the US SEC had reportedly sought court permission to serve summons via email to Gautam Adani and Sagar Adani. In response, Gautam Adani reportedly hired a new legal team led by Robert J Giuffra Jr., a prominent attorney and co-chairman of the law firm Sullivan and Cromwell.
