Delhi High Court Allows Reliance to Continue Marketing Campa as 'Energy Drinks'

The Delhi High Court has temporarily allowed Reliance Industries to market its Campa products as "energy drinks," challenging a Food Safety and Standards Authority of India (FSSAI) ban. The court questioned FSSAI's lack of prior notice to Reliance.

In a significant interim relief for Reliance Industries, the Delhi High Court on Tuesday permitted the company to continue marketing its Campa brand beverages as "energy drinks." This decision comes despite a recent order from the Food Safety and Standards Authority of India (FSSAI) that sought to prohibit manufacturers of high-caffeine beverages from using this description.

Court Questions FSSAI Procedure

During the hearing, the Delhi High Court questioned the FSSAI's legal counsel regarding the absence of a prior notice issued to Reliance before implementing its June 30 order. The court emphasized that it was "never too late" for the regulatory body to correct its procedural oversight. The case is scheduled for its next hearing on November 5.

Impact on Reliance and Broader Market

Reliance Consumer Products, the beverage arm of Reliance, had filed a plea against the FSSAI directive earlier this month. The company stated in its filing that it holds a substantial inventory of 168 million cans and 120 million plastic bottles, along with pre-printed packaging for an additional 400 million cans and 360 million bottles, all bearing the "Energy Drink" label. State authorities had previously seized Reliance stock and instructed e-commerce platforms to remove the products, causing considerable operational disruption.

The FSSAI's crackdown is part of a wider, India-wide food safety initiative this year, driven by increasing concerns over the health implications of such products. Other major players in the market, including PepsiCo and Monster Beverage, have also filed similar pleas against the FSSAI. Austria's Red Bull had previously secured a court reprieve allowing it to continue using the "energy drink" designation.

Campa's Revival and Market Ambitions

Reliance revived the iconic Campa brand in 2023, leveraging its extensive retail network and competitive pricing to challenge established players like Coca-Cola and PepsiCo. The FSSAI's labeling ban posed a significant threat to Campa's ambitions in India's rapidly expanding energy drinks market, which, according to Euromonitor, is growing at an annual rate of 12.6%, outstripping growth in the US and China.
