The Supreme Court of India has signaled its intent to permit the use of specific firecrackers during Diwali, but only within prescribed timeframes. This stance rejects both a complete prohibition on firecrackers and the option for unrestricted use throughout the festival.
Balancing Tradition and Environment
A bench comprising Justices MM Sundresh and PB Varale emphasized the necessity of striking a balance. A total ban, they noted, could offend the sentiments of those celebrating Diwali, while allowing continuous use would severely impact the environment and vulnerable populations, including children, the elderly, and the sick.
"We are neither going to agree for a total ban nor allow them to do it for 24 hours," the court stated, highlighting its commitment to establishing specific timings for permissible firecrackers.
This decision comes as the apex court addresses a long-standing case concerning firecracker restrictions, particularly in Delhi-NCR and other northern states, which frequently experience severe air pollution during the festive season.
Consideration of 'Larri' and Barium-Based Crackers
The bench also indicated a willingness to consider allowing joint firecrackers, commonly known as 'larri', subject to certain conditions. Additional Solicitor General Aishwarya Bhati requested time until October 15 to submit a report from the Central Pollution Control Board (CPCB) on barium-based firecrackers, noting that outdoor testing for these crackers was still pending.
The court granted the extension, stating it would review the CPCB report before finalizing which categories of firecrackers could be permitted. In July, the Supreme Court had previously inquired with the CPCB about the possibility of allowing certain firecracker types with potential relaxations in noise-related restrictions.
Background of the Case
The ongoing legal proceedings originate from a 2015 case that has led to a series of Supreme Court directives regulating the manufacture, sale, and use of firecrackers. These measures were primarily prompted by the escalating air quality crisis in Delhi and surrounding regions. While the court initially imposed a blanket ban on firecrackers in Delhi, it later amended its orders to permit the sale and bursting of approved green firecrackers in Delhi-NCR for a limited period around Diwali in 2025.
