Supreme Court Quashes Proceedings Against Comedians
The Supreme Court of India has quashed criminal proceedings against prominent comedian and YouTuber Samay Raina, along with four other comedians, concerning allegedly insensitive remarks made about persons with disabilities. The ruling, delivered by a Bench comprising Chief Justice of India Surya Kant and Justices Joymalya Bagchi and V Mohana, brings an end to a controversy that began with a show recorded in late 2024.
Besides Raina, the relief was extended to comedians Vipul Goyal, Balraj Paramjeet Singh Ghai, Sonali Thakkar alias Sonali Aditya Desai, and Nishant Jagdish Tanwar. The case stemmed from comments made during an episode of the show “India’s Got Latent,” recorded at Khar Habitat on November 14, 2024. These remarks sparked widespread controversy, particularly regarding individuals living with Spinal Muscular Atrophy (SMA).
The legal proceedings were initiated partly due to a plea from the Cure SMA India Foundation, which raised significant concerns about the dignity of persons with disabilities and the detrimental impact of insensitive online content.
Comedians' Efforts to Support the Disability Community
During the hearing, the Supreme Court took positive note of the comedians' proactive efforts to engage with and support the disability community. The Bench observed, “Once there are genuine efforts positive results are bound to be there. They are very bright youngsters. If they have started working in positive direction, there will be positive output.”
The court was informed that Raina and his fellow comedians had organized a chess tournament specifically for persons with disabilities in Pune during March. Furthermore, they had planned four additional fundraising shows dedicated to this cause. These initiatives culminated in approximately ₹12.5 crore being raised through their shows, earmarked for the welfare of persons with disabilities. The comedians also expressed their commitment to inviting individuals living with SMA to their programs and providing financial assistance.
Court Acknowledges Constructive Dialogue and Compliance
This development follows earlier directives from the Supreme Court, which had instructed the comedians to organize events aimed at supporting persons with disabilities. Initially, the court had imposed costs of ₹3 lakh each on them due to concerns regarding compliance with these directions.
The Bench also acknowledged the positive interaction and “constructive conversation” that had taken place between the comedians and the Cure SMA India Foundation. The court noted that the comedians had expressed gratitude to the NGO for its guidance in organizing programs and working towards the welfare of the SMA community.
Concluding the matter, the Supreme Court found that its earlier directions had been adequately followed. “We have no doubt that respondents 6-10 will work hard in their endeavour to organise events for celebrating the lives and increasing dignity of SMA warriors,” the Bench stated, formally closing the proceedings and quashing the criminal cases against the five comedians.
