India's capital markets regulator, the Securities and Exchange Board of India (SEBI), has imposed a seven-year ban from the securities market and a substantial ₹3 crore monetary penalty on Viresh Joshi, the former chief dealer at Axis Mutual Fund. This stringent action comes as a result of Joshi's alleged involvement in a significant front-running case.
Widespread Penalties for Market Misconduct
In its comprehensive final order, SEBI also extended penalties to 20 other individuals connected to the same front-running scheme. These individuals face debarment from the securities market for periods ranging from three to seven years, alongside monetary penalties between ₹10 lakh and ₹1 crore, depending on their specific roles in the alleged violations.
The regulatory body initiated its investigation into suspected front-running activities involving trades executed on behalf of Axis Mutual Fund following an interim order-cum-show cause notice issued in February 2023. The alleged illicit transactions are believed to have occurred between September 1, 2021, and March 31, 2022. SEBI had previously estimated that the accused parties collectively made wrongful gains totaling approximately ₹30.55 crore, which were subsequently impounded through the interim order.
Understanding Front-Running
Front-running is an illegal and unethical market practice. It involves a person trading in securities based on advance, non-public knowledge of large institutional orders. By executing personal trades before these large orders, the individual seeks to profit from the expected price movement that will occur once the significant institutional orders are carried out, thereby gaining an unfair advantage over other market participants.
Debarment Period Adjustment
SEBI's final order clarifies that the duration for which the individuals have already been barred from the securities market under the interim directions will be adjusted against the newly imposed debarment periods. This means the time already served under restraint since the February 2023 interim order will be factored into the calculation of their remaining ban.
