Issued by the Office of the Commissioner of Food Safety in Bengaluru, the notification explicitly cites paramount public health concerns as the primary motivation for this statewide measure. This decision underscores the state's commitment to safeguarding its citizens from the detrimental effects of tobacco consumption.
The ban extends beyond traditional gutkha and pan masala products. It specifically includes any items marketed separately that, in their final form, incorporate tobacco or nicotine. This applies irrespective of their branding, packaging, or whether they are sold as individual components.
Furthermore, the prohibition also covers products designed or distributed in a manner that facilitates easy mixing by consumers, ensuring that loopholes cannot be exploited to circumvent the health directive.
Legal Framework for the Ban
The regulatory action was taken under the authority of Section 30(2)(a) of the Food Safety and Standards Act, 2006. This is further read in conjunction with Regulation 2.3.4 of the Food Safety and Standards (Prohibition and Restrictions on Sales) Regulations, 2011, providing a robust legal foundation for the state's intervention. The order, signed by the Commissioner of Food Safety and Drug Administration, Bengaluru, will remain in force for a full year from its notification date.
