A consumer court in Jharkhand has directed the South Eastern Railway to pay ₹35,000 in compensation to a passenger whose train was delayed by nearly nine hours. The Seraikella-Kharsawan District Consumer Disputes Redressal Commission ruled that such a significant delay amounted to a "deficiency in service," causing the passenger, Sanjay Kumar, physical, mental, and financial harassment.

Details of the Nine-Hour Delay

The incident dates back to September 2024 when Sanjay Kumar booked two sleeper-class tickets on the Ispat Express for a journey from Tatanagar (Jamshedpur) to Sambalpur. According to the commission’s records, the train arrived at Sambalpur a staggering 8 hours and 48 minutes behind its scheduled time.

Kumar filed a complaint, leading to the commission's order on September 2, 2026. The panel, headed by President Sunil Kumar Singh, along with members Pradeep Kumar Mishra and Sanju Shahi, observed that Kumar had presented "cogent and convincing evidence" of the distress caused by the prolonged delay.

Court Rejects Railway's Arguments

The Railways had attempted to challenge the complaint on grounds of jurisdiction and non-joinder of necessary parties. They also argued that the complainant had not produced documentary proof of specific financial loss. However, the commission firmly rejected these objections.

The court emphasized that a prolonged delay in train service, under these circumstances, inherently constitutes a deficiency in service as per consumer protection laws. This entitles the affected passenger to compensation, even without explicit financial loss documentation, provided harassment or inconvenience can be demonstrated.

Compensation Breakdown and Deadline

The total compensation awarded to Sanjay Kumar is ₹35,000. This amount comprises ₹30,000 specifically for the harassment endured due to the delay and an additional ₹5,000 to cover litigation costs incurred by the passenger.

The South Eastern Railway has been given 45 days from the date of the order to disburse the compensation. Should they fail to comply within this timeframe, the sum will accrue interest at a rate of 12 percent per annum from the date of the order until the payment is fully realized, enforceable through due process of law.
